The trial for Collier Kirksey began Monday, May 20 with jury selection.

Jury selection began for the third suspect accused of attempted murder and robbery of a Winn-Dixie store in Mobile. That incident ended with a Mobile police officer critically wounded.

Collier Kirksey is one of three suspects accused of the March, 2012 robbery of a Winn-Dixie store on Government and South Catherine Streets. Kirksey is the last of the three to go before the court.


We learned, that Kirksey accepted the plea to testify against his friends. But his attorney didn't agree with it. So the plea was threw out.  


Investigators said Kirksey was the "master-mind" of the incident. He worked at the Winn-Dixie at the time. Byrd claims his client is innocent.

"They're confused and mistaken. He's not the mastermind behind this. He didn't put it together. Ronald Crear, and Jackieth Harrison committed this robbery 100 percent," Byrd said.

Harrison just went to trial and was found guilty. Crear pleaded guilty and did not have a trial. Jurors in Harrison's trial saw this dramatic video from Officer Chad Wynne's body cam, the night he was shot.

Wynne was shot in the chest and had to be rushed to USA Medical Center. He underwent several surgeries and survived.


Kirksey is charged with first-degree robbery and five counts of attempted murder, just like Crear and Harrison.

Opening statements started Monday afternoon.

Harrison is scheduled for sentencing May 30. Crear was sentenced to consecutive life prison terms for the first two attempted-murder charges and concurrent life sentences on the other four offenses.
